Customs
are widely accepted ways of doing something which are not opposed to rules of
natural justice, equity and good conscience. These ways have been existing as a
practice since a long time and in a continuous manner. Law based on customs is
known as customary law.
Customary
law need not always be in writing because the people are well aware on how
things are usually done based on their regular practice. Many laws originate
from customs and at times the widely accepted customs are legislated and we
have enacted laws based on the customs.
Source
of law means the origin of law and at times we find customs are the source from
which many laws have come into existence in the society. They do have a binding
effect on the people and play a major role in one’s life.
